  Teaching Plan for “Junior College Graduates to Undergraduate Diploma” Program for the major of Law in the Institute of Distance Education of Nanjing University

1. Introduction

The Law School of Nanjing University grew out of the Law School of the former National Central University. The school stopped recruiting since the nationwide readjustment of universities in 1952 and was restored in 1981. In 1994, the school was upgraded from a department to the School of Law.

The Law School has a faculty body of 68, of whom there are 15 professors, 16 associate professors, 16 lecturers, 10 teaching assistants and 11 administrative officers. Of the teaching staff, 19 have obtained PhD degrees and 16 are PhD candidates.

The programs offered by the Law School produce cutting-edge work in a wide range of fields and disciplines, from one law major for undergraduates to 9 programs for masters including legal principle, history of law, constitution and administrative law, business law, international law, civil and commercial law, criminal law, civil and criminal procedure law. The school also runs Juris Master’s program and PhD program in business law.

The Law School has established such research institutes and organizations as the Sino-German Institute for Law (originally known as Chinese-German Institute for Business Law ), Research Center of Real Estate and House Policies,  Institute of Asian and Pacific Laws, and Institute for Crime Prevention and Control. The Sino-German Institute for Law, under the cooperation between Nanjing University and Gottingen University in Germany, is the sole center in China for international legal research and teaching. The institute has made remarkable achievements in joint graduate programs.

The two academic journals Forum of Chinese-German Legal Research and Nanjing University Law Review published by the Law School have received applauses from academia at home and abroad. Since 1981, over 100 academic books and textbooks have been published and over 1000 papers are published in major international and national journals. The achievements of the Law School have won several national and provincial awards.

Guided by the educational principles of Chinese government, following Mr. Deng Xiaoping’s teaching philosophy of “facing the directions of modernization, the world and the future” to meet the needs of the market economy and the legalization of society, the Law School implements the teaching policy of “being rigorous, truthful, diligent, and innovative” and “providing an all-round training, consolidating foundation, teaching according to students aptitude, and building up vitality”. The objective of the Law School is to cultivate legal talents and to head to the first-class law school. By taking advantage of the comprehensive programs offered at Nanjing University, a teaching system combining theory with practice has been set up to train high-level and versatile legal talents with a focus on the practice of law. 

To answer the call for legal talents in the development of socialist market economy and to improve the construction of disciplines of law, Nanjing University has set the Law School as the discipline of priority in financial support.

2. Targets of Cultivation

The programs are offered to meet the demands of socialist market economy and legalization of the state after China’s entry into the WTO. By making using of the modern teaching aids such as the Internet, the program is to train legal talents in the practice of law to meet the social needs. After graduation, graduates will practice law in judicial departments, administrative departments, legal services and enterprises such as court, procuratorate, police, law offices, and notarization offices.

3. Subjects and Scales of Cultivation

After 3 years’ systematic study, students are expected to have a good command of the basic principles of China’s legal system and the fundamental theories of law major. Students are expected to master the essential skills of law practice as well as the writing skills in legal thesis, case studies and judicial writs. Students are required to be skilled in both speaking and writing so that they have a solid foundation in theories and practice.

4. Length of Schooling

The program adopts academic year credit system and the length of the schooling is basically three years with a flexible system of 5 years at most and 2 years at least.

5. Syllabus Design

The courses of the program include general required courses, core courses, selective courses and graduation thesis.

The program runs 4 general required courses with a total of 20 units of credit: Theory of Deng Xiaoping, Computer Basics, College English, College Chinese.

The program offers 11 core courses with a total of 44 units of credit: Science of Law Theory, Science of Civil Law, Science of Criminal Law, Science of Administrative Law, Science of Code of Administrative Procedure, Science of Code of Civil Procedure, Science of Code of Criminal Procedure, Science of Business Law, Science of Law of Intellectual Property, Science of Business Law, Science of Law of Nations, and Pandect of International Business Law.

There are 5 general selective courses and 2 specialized selective courses with a total of 28 units of credit. Students must get at least 8 units of credit from general selective courses, at least 4 of which should be from specialized selective courses of the major. The 5 general selective courses are Official Document Writing, Business Spoken English, Western Culture, Introduction to World Economy, and Design and Composition of Webpage. The 2 specialized selective courses of the major are Lawyer Practice and Science of Constitution.

The graduation thesis has 8 units of credit.

6. Teaching Process

The program mainly adopts distance teaching on the Internet and the teaching approaches include lectures on the Internet, real-time Q&A, after-class assignment, on-line discussion, test of course, graduation thesis.

a.       Online teaching

On-line lectures are given on the Internet by experienced and responsible teachers of Nanjing University. For each course, a group of teachers will work together to make teaching plan, choose teaching materials and make multi-media courseware suitable to the on-line lectures.

On-line lectures focus on the combination of theories and practice as well as students’ all-around abilities in the practice of law. Based on the principles of laws, the lectures will study legal systems, analyze legal cases and integrate legal theories with case studies.

b. Online learning guidance

According to the arrangement of teaching plan, the teaching staff will answer students’ questions on the Internet and solve the problems that students come across in study. The interaction between teacher and students is emphasized to improve teaching effect. The feedbacks from students are collected and adjustments will be made in terms of teaching plan and content.

c. After-class assignment

After-class assignments are the major approach to motivate students to understand and consolidate the knowledge acquired from lectures. For each course of the program, after-class assignments will be given in different stages of teaching and feedback together with grades will be calculated in the final assessment of the course. After-class assignments place emphasis on the case study and profound understanding of questions given to test and train students’ abilities in terms of legal knowledge use and practice of law.

d. On-line discussion

On-line discussion is another major component of distance teaching. Teachers will ask students to have a discussion of a specific question and exchanges views on the issue at a designated period of time.      

e. Assessment

The assessment includes the grades of after-class assignment, tests, performance in on-line discussion and final test.    

f. Graduation thesis

After students complete all the courses of the program, students will choose the topics of their graduation thesis and finish the thesis independently under the supervision of their tutors. Graduation thesis represents students’ achievements in study and has 8 units of credit. Those whose fail graduation thesis cannot obtain diploma of graduation.     

g. Conferring Degree

Students who finish all the prescribed courses within the elastic schooling system with a distinguished performance in both courses and graduation thesis can apply for a bachelor’s degree. Those who comply with the Bachelor’s Degree Conferring Rules for Distance Learning Students of Nanjing University will be conferred the degree of Bachelor of Laws.
